Why This Depends On Where You Live, Not On What You Post
There is no federal "UGC creator license." The IRS does not require a license to earn money from brand deals, AdSense, affiliate links, or a TikTok Creator Fund. What the IRS cares about is that you report the income and pay self-employment tax, not whether a city hall stamp exists on a certificate.
Business licenses are a local matter. Many cities and counties require anyone earning income from a trade or business, including a sole proprietor working from a bedroom, to get a general business license or business tax certificate. Others only require this once you hit a revenue threshold or operate from a commercial location. Some places have no general licensing requirement at all for home-based, one-person businesses. The only way to know for sure is to check your city clerk's website and your county's business licensing office.
What Actually Triggers A License Requirement
A few things commonly trigger a local license or permit even for a solo creator:
- Operating a business from your home in a city that requires a home occupation permit
- Earning above a local gross receipts threshold that requires a business tax certificate
- Selling physical merch, since some states require a seller's permit or sales tax license to collect and remit sales tax
- Using a business name that is not your own legal name, which usually requires a DBA (doing business as) filing, separate from a license
Notice that a DBA and an LLC are not the same thing as a business license. A DBA just registers a name. An LLC is a legal entity structure. A business license is a local permit to legally operate. A creator can have any combination of these, or none, depending on their state and city.
What UGC Creators Should Actually Prioritize
Before worrying about a license you may not even need, get the tax basics right, because those apply everywhere:
- File Schedule C to report income and expenses from your creator work as a sole proprietor, and Schedule SE to calculate self-employment tax on net profit above $400.
- Track every 1099-NEC and 1099-K from brands, platforms, and payment processors like PayPal or Stripe, since income from all of them gets combined on Schedule C, not reported separately.
- Make quarterly estimated tax payments using Form 1040-ES, since no one withholds taxes from brand deal payments or ad revenue.
- Deduct real business costs: camera gear, editing software subscriptions, lighting, a portion of home internet, and a reasonable share of a home studio space.
When To Actually Check On A License
Search your city name plus "business license" or call your county clerk's office. If you plan to form an LLC for liability protection or brand credibility, ask your state's Secretary of State whether that filing also satisfies local licensing, since some states bundle them and some don't. If you sell merchandise directly to fans, check your state's sales tax requirements separately, since that is a different registration than a general business license.
